SOYKIRIM SUÇUNUN MANEVİ UNSURU (MENS REA) VE MANEVİ UNSURUN YORUMLANMASINA DAİR YAKLAŞIMLAR

چکیده
Soykırım suçunun uluslararası hukukta kabul edilen tanımı çerçevesinde, ulusal, etnik, ırksal veya dini bir grubu “tamamen kısmen yok etme kastı” şeklinde ortaya çıkan suçun manevi unsuru (mens rea), diğer unsurlardan adım öne çıkmaktadır. Zira unsur, soykırım adam öldürme suçundan insanlığa karşı suçlar altında incelenebilecek suçlardan ayrılmasını sağlayan öğesidir. Bu öneminden dolayıdır ki; öğretide suçu “mens rea suçu” olarak da anılmaktadır. Bununla birlikte, unsurun somut olayda ispat edilmesi, failin suç işlediği sırada taşıdığı amacın, deyişle zihinsel durumunun, konulmasını gerektirdiğinden çoğu zaman son derece güçtür. Buna ek olarak, niteliği gereği belli organizasyon ve yapılanma dahilinde, her seviyeden katılımını gerektiren açısından, ilgili taşıması gereken kastının içerik yoğunluğu da, bu fail için edilecek standart bakımından yorumlanmasını gerektirmekte olup, uygulama konuda çeşitli yaklaşımlar konulmuştur. çalışmada, şüphesiz en ayırıcı özelliği olan unsura yorumlanmasına dair yaklaşımlara daha yakından bakılmıştır.
